Terms and Conditions of Sale

Welcome to SoundStore. By using our assisted purchasing and international forwarding services (the “Service”), you agree to be bound by these Terms and Conditions (the “Terms”). Please read these Terms carefully before placing an order.

1. Our Role

SoundStore provides international assisted purchasing and forwarding services. We act as your authorised purchasing and logistics agent to assist you in purchasing products from third-party retailers, suppliers, websites, and online marketplaces (collectively, “Third-Party Sellers”) and arranging delivery to your nominated address.

SoundStore is not the manufacturer, retailer, distributor, or supplier of the products purchased through the Service. Our role is limited to:

• Carrying out your purchasing instructions;
• Making payment to the relevant Third-Party Seller on your behalf; and
• Coordinating the international and domestic transportation of your order.

SoundStore does not sell the products to you as a retailer, does not manufacture the products, and does not provide any manufacturer’s warranty or guarantee in relation to the products.

2. International Fulfilment and Delivery

SoundStore operates through a global network of distribution centres, freight providers, courier services, and logistics partners to facilitate efficient international order fulfilment.

Orders destined for Australia may be shipped from various countries, including locations in Asia, Europe, North America, or other regions, depending on product availability, supplier location, and logistics requirements.

Where available, tracking information will be provided for shipments.

All delivery timeframes are estimates only and are not guaranteed. Delivery may be delayed by circumstances outside SoundStore’s reasonable control, including customs processing, border restrictions, carrier delays, weather events, public holidays, industrial action, transport disruptions, or other unforeseen circumstances.

3. Taxes, Customs and Import Duties

Unless expressly stated otherwise at the time of purchase, SoundStore does not charge or collect GST, customs duties, import taxes, or other government charges on your behalf.

You are solely responsible for any applicable:

• GST, import taxes, or other government charges;
• Customs duties and tariffs;
• Customs clearance or brokerage fees;
• Quarantine, inspection, or handling charges; and
• Other fees imposed by customs authorities, government agencies, or carriers.

Where applicable, these amounts must be paid directly to the relevant courier, customs authority, or other authorised agency before or upon delivery.

Such charges are separate from SoundStore’s Service fees and are not included unless expressly stated.

SoundStore is not responsible for customs inspections, import restrictions, clearance delays, seizure, additional charges, or other consequences arising from the importation of goods into your country.

4. Product Quality, Warranties and Liability

SoundStore does not manufacture, distribute, or directly sell the products purchased through the Service. Accordingly, we do not make any representation or guarantee regarding the quality, condition, safety, functionality, suitability, legality, authenticity, or durability of any product supplied by a Third-Party Seller.

Any product-related matter, including:

• Product defects or faults;
• Manufacturer warranties;
• Recalls;
• Product safety concerns;
• Exchanges or replacements;
• Product specifications or performance; or
• After-sales support

must be addressed directly with the applicable Third-Party Seller or manufacturer, subject to their applicable terms and policies.

SoundStore’s responsibility is limited to facilitating the purchase and shipment of products in accordance with your instructions.

To the maximum extent permitted by applicable law, SoundStore’s total liability arising from or relating to a particular order will be limited to the Service fees paid to SoundStore for that specific transaction.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies that cannot lawfully be excluded, restricted, or modified under applicable consumer protection laws.

5. Refunds, Returns and Cancellations

As SoundStore is not the original retailer or manufacturer of the products, we generally cannot accept product returns or issue refunds for products purchased through the Service.

Requests relating to product returns, exchanges, refunds, defects, or warranties must be directed to the applicable Third-Party Seller or manufacturer.

SoundStore Service fees are generally non-refundable once the requested purchasing or fulfilment services have commenced, except where:

• A refund is required by applicable law; or
• A verified error attributable to SoundStore has materially affected the Service.

Where a Third-Party Seller issues a refund, SoundStore may assist with processing or facilitating the refund where reasonably possible. Any refund remains subject to the Third-Party Seller’s policies and the payment method used for the original transaction.

6. Pricing and Payment

Unless otherwise stated, all prices displayed by SoundStore are in Australian Dollars (AUD) and exclude GST and any applicable customs duties, import taxes, or government charges.

Orders will generally be processed only after full payment has been received and successfully cleared.

SoundStore reserves the right to:

• Cancel or decline an order where a product is unavailable or cannot reasonably be sourced;
• Correct typographical, product, currency, or pricing errors;
• Cancel an order where the displayed price is materially incorrect;
• Decline transactions where fraud, misuse, or suspicious activity is reasonably suspected; or
• Refuse an order where fulfilment would breach applicable laws, regulations, sanctions, or carrier restrictions.

Where an order is cancelled by SoundStore before fulfilment due to an error or unavailability, any applicable refund will be handled in accordance with these Terms and applicable law.

7. Prohibited and Restricted Products

SoundStore may refuse to purchase, process, forward, or deliver products that are prohibited or restricted by applicable laws, customs regulations, carriers, payment providers, or our logistics partners.

This may include products subject to import restrictions, licensing requirements, dangerous-goods regulations, or other legal limitations.

You are responsible for ensuring that any products you request are lawful to purchase, import, possess, and use in your destination country.

SoundStore reserves the right to cancel or refuse any order where the requested product cannot lawfully or reasonably be fulfilled.

8. Disclaimer

SoundStore acts solely as an assisted purchasing and logistics facilitator. Our Service is intended to provide customers with convenient access to products available from international Third-Party Sellers.

SoundStore does not control the manufacturing, quality control, product specifications, safety standards, availability, pricing, warranties, or after-sales policies of Third-Party Sellers.

To the maximum extent permitted by applicable law, SoundStore is not responsible for any loss, damage, defect, delay, injury, recall, regulatory issue, or other matter arising from the products themselves or the acts or omissions of a Third-Party Seller, manufacturer, courier, customs authority, or other third party.

By using the Service, you acknowledge and agree that:

• The Third-Party Seller or manufacturer remains responsible for the product and any applicable product warranty;
• Product-related claims should generally be directed to the relevant Third-Party Seller or manufacturer;
• Delivery timeframes are estimates and are not guaranteed; and
• SoundStore’s liability is limited to the extent permitted by applicable law and as otherwise set out in these Terms.

9. Customer Responsibilities

You are responsible for providing accurate and complete information required to process your order, including your name, delivery address, contact details, and any other information reasonably required for fulfilment.

You are also responsible for reviewing product information, specifications, compatibility, measurements, quantities, and applicable import requirements before placing an order.

SoundStore is not responsible for delays, additional costs, or failed delivery resulting from incorrect, incomplete, or outdated information supplied by you.

10. Governing Law

These Terms are governed by the laws applicable in the jurisdiction in which SoundStore operates, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts in that jurisdiction, except where applicable consumer protection laws provide otherwise.

11. Changes to These Terms

SoundStore reserves the right to update or amend these Terms from time to time. Updated Terms will apply to orders placed after the revised Terms are published, unless otherwise required by applicable law.

By continuing to use the Service after an updated version of these Terms takes effect, you acknowledge and agree to the revised Terms.
